RESOLUTION 03-92

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOMER FINDING THE NEED TO CREATE THE ROSEBUD COURT SEWER IMPROVEMENT/ASSESSMENT DISTRICT AND SETTING THE DATE FOR PUBLIC HEARING AS AUGUST 25, 2003.

WHEREAS, The Homer City Council finds the need to create a local improvement/ assessment district pursuant to HCC 17.04.030 (b) for sewer for those lots fronting portions of Rosebud Court, Diamond Willow Circle, Fireweed Avenue and East Hill Road; and

WHEREAS, These lots are contained in Bayview Gardens Subdivisions; and

WHEREAS, The district is desired by property owners who signed the petition in favor of the sewer improvements that equal 65.76% of the property value; and

WHEREAS, Donald and Mary Sanders have requested inclusion of the lots 6 and 7 of Block 7, KPB Parcel Nos. 173-595-0600 and 173-595-0700; and

WHEREAS, Estimated project cost as of June 2, 2003 is $397,500.00, 75% to be assessed to the property owners in equal shares per parcel is $298,125.00 for an estimated assessment to the property owners of $14,906.25; and

WHEREAS, If Council adds the two Sanders Lots the estimate will be re evaluated and new information forwarded to the property owners with the public hearing notice, preliminary assessment roll, official objection/non objection form and other information; and

WHEREAS, A public hearing is required and has to be advertised at least once a week for four consecutive weeks in a newspaper of general circulation within the City with notices sent to the affected property owners; and

WHEREAS, There will be a sixty day objection period which begins the day following Public Hearing date of Monday, August 25, 2003 and ends at 5 p.m. on Friday, October 24, 2003; and

WHEREAS, After the objection period closes a Resolution will be forwarded to the Council noting the results of the objection period wherein property owner objections are tallied.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Homer finds the need to create the Rosebud Court improvement/assessment district and sets the date for public hearing as August 25th , 2003 at a Regular Council Meeting; and

BE, IT FURTHER RESOLVED that KPB parcels 173-595-0600 and 173-595-0700, lots 6 and 7, Block 7 of Bayview Gardens Subdivision Addition No. 1.
