RESOLUTION 04-28

A RESOLUTION OF THE CITY COUNCIL AMENDING THE HILLSIDE ACRES WATER DISTRICT AND SEWER DISTRICT BOUNDARIES.

WHEREAS, Pursuant to engineering of the Hillside Acres Water and Sewer project the area that is benefitted by the project has changed from that anticipated when the water and sewer improvement/assessment districts were approved; and

WHEREAS, It has been ascertained that three parcels in the water district cannot be served with water, due to the fact that they are above service elevation, to the north and will be best served with water from a future transmission main from the north; and

WHEREAS, It has been ascertained that three parcels in the original sewer district cannot be served with sewer economically, these lots lie south of the Sterling Highway and will be best served with an adjacent sewer district on the south of the Sterling Highway; and

WHEREAS, There has been some lot reconfiguration via subdividing and lot line vacation; and

WHEREAS, Additional water and sewer mains were required along the Sterling Highway to connect the project to the existing mains at the bottom of West Hill Road; and

WHEREAS, Four parcels that were not included in the original improvement/assessment district are now benefitted from the project; and

WHEREAS, The owners of the three parcels that cannot be served by water and the owners of the three parcels that cannot be served by sewer have been notified and acknowledged, to Public Works, the deletion of this improvement to their property; and

WHEREAS, The owners of the four parcels being added have ben notified and Public Works provided them with two options; join the assessment district and be assessed with the district or accept a deferred assessment and pay one hundred percent (100%) of the cost due upon connection.

NOW, THEREFORE, BE IT RESOLVED by the City Council that the boundaries of the Hillside Acres Water District and Hillside Acres Sewer District are hereby amended as follows:

Parcels 175-030-4000, 4100 and 4200 (Skyline Drive Subdivision No. 6 Lots 1, 2 and 3) are hereby deleted from the Hillside Acres Water District Boundary: Owner of record. Charles M. and Debra L. Rehder

Parcel 175-082-4200 (previously two parcels - 175-082-0800 and 175-082-0700 - Binocular Bluff Subdivision Lots 9 and 10 Block 1)(now Binocular Bluff Subdivision #2 Lot 9A) is hereby deleted from the Hillside Acres Sewer District: Owner of Record is Dale E. Bondurant.

Parcel 175-082-0900(Binocular Bluff Subdivision Lot 11 Block 1) is hereby deleted from the Hillside Acres Sewer District: Owner of Record is Larry and Dawn D. Cabana

Parcel 175-081-0800 (Derose Subdivision Lot 7) is hereby added to the Hillside Acres Water District and Sewer District: Owner of Record is Michael M. Carlson.

Parcel 175-081-5100 (Tract B. Derose Subdivision) is hereby added to the Hillside Acres Water District and Sewer District: Owner of Record is Robert M. Haynes.

Parcel 175-081-0400 (Tract A. Derose Subdivision) is hereby added to the Hillside Acres Water District and Sewer District: Owner of Record is Diann Theresa Martin

Parcel 175-081-0300 (Derose Subdivision Lot 1) is hereby added to the Hillside Acres Water District and Sewer District: Owner of Record is Michael M. Carlson.

BE IT FURTHER RESOLVED, Pursuant to HCC 17.04.050(c), that the City Clerk shall make this change promptly and that the affected property owners will be notified of this change promptly by the City Clerk in writing.

Fiscal Impact: Estimated changes not provided by Public Works. Deleted three from each district and adding four would reduce the overall assessment amounts to the property owners unless the overall project cost has increased.
