RESOLUTION 04-50

A RESOLUTION OF THE CITY COUNCIL FINDING THE NEED TO CREATE THE SPRUCEVIEW ROAD RECONSTRUCTION AND PAVING LOCAL IMPROVEMENT DISTRICT (LID) AND SETTING A PUBLIC HEARING FOR JUNE 28, 2004.

WHEREAS, The owners of property fronting Spruceview signed the request for a petition for road reconstruction and paving improvements at the required 51% level thereby forwarding this LID to the petition phase; and

WHEREAS, A neighborhood meeting was held on Tuesday, May 11, 2004 at 5:30 p.m regarding the requested improvements and property owners and staff, as well as one Road Standards Committee member were in attendance; and

WHEREAS, Property owners signing the petition equal $395,700.00 property value or 71.48% excluding government owned properties; and

WHEREAS, The Homer City Council finds the need to create the Spruceview Road Reconstruction and Paving LID pursuant to HCC 17.04.030; and

WHEREAS, The deadline for this LID petition is June 29, 2004; and

WHEREAS, As discussed at the neighborhood meeting the neighborhood and staff, generally, would like to get this project moving to bring it to fruition as soon as possible.

NOW, THEREFORE, BE IT RESOLVED that the City Council hereby finds the need to create the Spruceview Road Reconstruction and Paving Local Improvement District and sets the date for public hearing as Monday, June 28, 2004 during the Regular City Council meeting that begins at 7:00 p.m. for the purpose of hearing protests against the formation of said improvement district; and

BE IT FURTHER RESOLVED, by the City Council that should the rest of the property owners, excluding the governmental agencies, sign the petition between now and the public hearing that the Council may agree to waive the 60 day objection period provided that the involved property owners agree thereto in writing by signing a waiver to that effect.

Fiscal Note: Property owner share of the project is $185,186.11, minus exemptions is $101,041.07. A project estimate has not been submitted by Public Works. Assessments are: $30 per front foot for reconstruction and $17 per front foot for paving.
