RESOLUTION 04-55

A RESOLUTION OF THE CITY COUNCIL AFFIRMING THE WATER AND SEWER (SPAGHETTI) LINE INSTALLATION POLICY IN HOMER CITY CODE CHAPTERS 13.24 AND 13.28.

WHEREAS, Homer City Code Subsection 13.24.040(f), states that sewer service lines may not be installed to property which does not have a main directly adjacent to it except when no other main line will be constructed to service the property and then only with the permission of the Public Works Director; and

WHEREAS, Homer City Code Section 13.28.030(f), states that water service lines may not be installed to property which does not have a main directly adjacent to it except under where no other main line will be constructed to service the property and then only with the permission of the Public Works Director; and

WHEREAS, Public Works has reluctantly granted permission from time to time for spaghetti lines; and

WHEREAS, Memorandum 04-87 outlines some of the problems associated with granting the installation of spaghetti lines.

NOW, THEREFORE, BE IT RESOLVED that the City Council hereby affirms the water and sewer (spaghetti line) installation policy as reflected in Homer City Code Chapters 13.24 and 13.28; and

BE IT FURTHER RESOLVED, that the Council hereby affirms and endorses the interpretation of the Homer City Code and approach to administering said Code presented by the Public Works Department in Memorandum 04-87, a copy of which is attached and incorporated herein.
