RESOLUTION 04-76





A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA, AUTHORIZING THE FORMATION OF THE SPRUCEVIEW ROAD RECONSTRUCTION AND PAVING ASSESSMENT DISTRICT AND AUTHORIZING THE CITY MANAGER TO PROCEED WITH THE PREPARATION AND CONSTRUCTION OF THE SPRUCEVIEW ROAD RECONSTRUCTION AND PAVING PROJECT.

WHEREAS, The Spruceview Road Reconstruction and Paving assessment district boundary includes Harrington Heights Subdivision Block 3 Lots 9 - 16 and Block 4 Lots 9 - 16 and Bunnell's Subdivision No. 17 Lots 11 A. - 13B and a portion of Lot 13 lying West of the Stream Bed, Homer School Survey 1999 City Addition Tract 1 and A. Anderson Tract 1003 Addition Tract A., which are located fronting Spruceview Avenue; and

WHEREAS, Resolution 04-50 was adopted on May 25, 2004 declaring Council's intention to create the Spruceview Road Reconstruction and Paving Improvement/Assessment District and to set a public hearing date and objection period; and

WHEREAS, A Public Hearing was held on June 28, 2004; and

WHEREAS, The objection deadline for written protests was August 27, 2004 and no written objections were received; and

WHEREAS, Marvin L. and Judith K. Hanson, owners of Lot 11 A Bunnell's Subdivision No. have requested, via letter dated June 28, 2004, consideration be given to them to negotiate an access across the westerly forty feet of Lot 11A.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Homer, Alaska that the formation of the Spruceview Road Reconstruction and Paving Assessment District is hereby authorized and that the City Manager is hereby authorized to proceed with the preparation and construction of said project.

PASSED AND ADOPTED by the City Council of Homer, Alaska this 13th day of September, 2004.

Fiscal Note: Project No: 160-766: Property owner share of the project is $185,186.11, minus exemptions is $101,041.07. A project estimate has not been submitted by Public Works. Assessments are: $30 per front foot for reconstruction and $17 per front foot for paving.
