RESOLUTION 04-85



A RESOLUTION OF THE CITY COUNCIL FINDING THE NEED TO CREATE THE EAST END ROAD WATER AND SEWER LOCAL IMPROVEMENT DISTRICT AND SETTING A PUBLIC HEARING FOR NOVEMBER 8, 2004.

WHEREAS, The owners of property fronting East End Road were contacted by Public Works to ascertain property owner interest in water and sewer improvements; and

WHEREAS, The City Council discussed Memorandum 04-09(S) during their Regular Meeting of January 12, 2004 an gave direction to the City Manager; and

WHEREAS, Memorandum 04-09(S) outlined the cost to property owners for an assessment district as compared to a deferred assessment; and

WHEREAS, Public Works sent letters to affected property owners advising them of the differences in an assessment and a deferred assessment, and conducted a neighborhood meeting; and

WHEREAS, The City Council adopted Resolution 04-42(A) during their Regular Meeting of May 10, 2004, authorizing the Local Improvement District petitioning process; and

WHEREAS, The petition process was conducted pursuant to Homer City Code (HCC)17.04.030; and

WHEREAS, The Council adopted Resolution 04-74, on August 23, 2004, noting the insufficiency of the petition and authorized the City manager to proceed with the deferred assessment methodology; and

WHEREAS, Property owners were immediately notified and sent copies of Resolution 04-74; and

WHEREAS, Property owners contacted the City asking that the petition be opened for additional signatures; and

WHEREAS, The initial deadline was July 26, 2004 and property owners requested additional time to collect additional signatures since property owners will be paying for the improvements even if the district fails; and

WHEREAS, Administration ascertained that it was in the best interest of the property owners, Citizens of Homer and the City to reopen the petition for additional signatures; and

WHEREAS, Additional signatures were received, resulting in property owners' signatures equaling $2,975,000.00 property value or 70.12%; and

WHEREAS, The Homer City Council finds the need to create the East End Road Water and Sewer LID pursuant to HCC 17.04.030; and

NOW, THEREFORE, BE IT RESOLVED that the City Council hereby finds the need to create the East End Road Water and Sewer Local Improvement District and sets the date for public hearing as Monday, November 8, 2004 during the Regular City Council meeting that begins at 7:00 p.m. for the purpose of hearing protests against the formation of said improvement district.

Fiscal Note: Sewer - Total cost estimated is $303,911.79; 75% = $227,933.84; would be assessed against each of 11 parcels = $20,721.26, twenty year payment plan at 2.5% interest. Water- Total cost estimated is $334,719.27; 75% = $251,039.45 would be assessed against each of 16 parcels = $15,689.97, twenty year payment plan at 2.5% interest.
