RESOLUTION 04-90

 

 

A RESOLUTION OF THE HOMER CITY COUNCIL SUPERCEDING AND REPLACING RESOLUTION 03-110A AND EXTINGUISHING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND THE HOMER HOCKEY ASSOCIATION REGARDING CONSTRUCTION OF THE PROPOSED NEW ICE RINK.

 

WHEREAS, over the past few years, the City of Homer and the Homer Hockey Association (HHA) have formed a partnership and worked cooperatively to build an ice rink and to bring Arctic Winter Games events to Homer, and

 

WHEREAS, through adoption of Resolution 03-110A and Memorandum 03-139, the Homer City Council approved a Memorandum of Understanding between the City and HHA which formalized and set out the roles and responsibilities of the parties with respect to construction and management of the proposed new facility, and

 

WHEREAS, for a variety of reasons, conditions have changed and the proposed new facility will now be located on private land, and constructed, maintained, and operated by private parties, and

 

WHEREAS, as a result of these developments, the City’s role in this partnership has changed significantly and it will no longer be responsible for purchasing land, constructing roads, water, and sewer lines, and maintaining and operating the building, and

 

WHEREAS, the Memorandum of Understanding between the parties is no longer applicable or relevant and should therefore be extinguished.

 

NOW THEREFORE BE IT RESOLVED, that the Homer City Council hereby expresses its continued strong support for the ice rink project and for the Arctic Winter Games, and

 

BE IT FURTHER RESOLVED, that the City will remain a partner by acting as the Official Host of the Games, providing technical assistance and coordination services where necessary, and doing whatever it can to support these efforts, and

 

BE IT FURTHER RESOLVED, that the Council hereby extinguishes the Memorandum of Understanding between the City and HHA and declares that this Resolution shall supercede and replace Resolution 03-110A.
