A RESOLUTION OF THE HOMER CITY COUNCIL SUPPORTING THE CONTINUATION OF THE SENIOR CITIZEN AND DISABLED VETERAN’S TAX EXEMPTION AND URGING THE ALASKA LEGISLATURE TO PROVIDE FULL REIMBURSEMENT TO MUNICIPALITIES AS PROVIDED BY LAW.
WHEREAS, A major part of the Alaska Municipal League legislative platform is to find a solution to the Senior Property Tax / Disabled Veteran Tax Exemption problem, and
WHEREAS, The Homer City Council discussed this exemption at its regular meeting on March 14, 2005 and adopted Memorandum 05-48 (A) which directed the City Manager to prepare a resolution supporting the continuation of the exemption and requesting that the legislature provide full reimbursement as provided by law, and
WHEREAS, AS 29.45.030 (e) states “ The real property owned and occupied as the primary residence and permanent place of abode by a resident 65 years of age or older; disabled veteran; or resident at least 60 years old who is the widow or widower of a person who qualified for an exemption…is exempt from taxation on the first $150,000 of the assessed value of the real property, and
WHEREAS, AS 29.45.030(g) states “ The state shall reimburse a borough or city, as appropriate, for the real property tax revenues lost to it by the operation of (e) of this section, and
WHEREAS, The Legislature has not funded reimbursements to municipalities for this exemption for many years, and
WHEREAS, The failure to fully fund reimbursements is an unfunded mandate which makes it increasingly difficult for municipalities to provide basic public services, and
WHEREAS, Providing reimbursement for this exemption could help replace Revenue Sharing and Municipal Assistance.

NOW THEREFORE BE
IT RESOLVED, That the Homer City Council hereby expresses its support for the [Tax
Exemption and request that the Alaska State Legislature fully fund
reimbursement to the municipalities.] Senior Citizen and Disabled
Veteran’s Tax Exemption as it presently exists, and
BE IT FURTHER RESOLVED, That the Council urges the Alaska Legislature to fully fund reimbursement to municipalities as provided by law.
