RESOLUTION 05-42
A RESOLUTION OF THE CITY COUNCIL FINDING THE NEED TO CREATE THE KACHEMAK DRIVE
PHASE ONE WATER LOCAL IMPROVEMENT DISTRICT AND SETTING A PUBLIC HEARING FOR
TUESDAY, MAY 24, 2005.
WHEREAS, The owners of property fronting Kachemak Drive Phase One from Government Lot 21, North and
South on the Western end of the district to Government Lot 2 North and South on the Eastern end of the district;
and
WHEREAS, Pursuant to Homer City Code (HCC) 17.04.030 the initial request had sufficient and proper
signatures to proceed to the petition phase; and
WHEREAS, Pursuant to HCC 17.04.030 a neighborhood meeting was held on January 11, 2005 in the Cowles
Council Chambers; and
WHEREAS, A petition was prepared by the City Clerk and, after review by the Public Works Department Staff,
the petition was issued to property owners to obtain signatures; and
WHEREAS, The petition process was conducted pursuant to HCC 17.04.030 with a deadline set of March 18,
2005; and
WHEREAS, Pursuant to HCC 17.04.030 the petition has sufficient and proper signatures equaling 60.71% of
property value.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby finds the need to create the Kachemak
Drive Phase One Water Improvement District/Assessment District and sets the date for public hearing as Tuesday,
May 24, 2005 during the Regular City Council meeting that begins at 7:00 p.m. for the purpose of hearing protests
against the formation of said improvement district.
PASSED AND ADOPTED by the HOMER CITY COUNCIL this 11th day of April, 2005.

estimated is $397,210.00. 75% = $297,907.50. Equal shares per parcel = $18,619.22.
