RESOLUTION 05-69
A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA APPROVING AND ADOPTING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF HOMER AND THE ENGLISH BAY CORPORATION REGARDING LOCAL MATCH REQUIREMENTS FOR THE FEDERAL DEPARTMENT OF TRANSPORTATION ARCTIC WINTER GAMES APPROPRIATION.
WHEREAS, Ordinance 05-24, approved April 25, 2005, authorized the City to accept and appropriate a federal earmark for Arctic Winter Games transportation improvements at the new Homer ice rink / multi-purpose facility in the amount of $400,000, and
WHEREAS, Ordinance 05-24 authorized and appropriated the required local match in the amount of $36,120 to be provided through a combination of cash, in-kind services, materials, and private donations,
WHEREAS, The City of Homer and the English Bay Corporation wish to work cooperatively on this project because they recognize that this transportation improvement will benefit both the private and public sectors, and
WHEREAS, The English Bay Corporation has agreed to evenly split the local match obligations with the City, and
WHEREAS, The City and the Corporation will work cooperatively to reduce the amount of cash needed by first contributing construction materials to the extent feasible and prudent, and
WHEREAS, The entire agreement between the City and the Corporation is contained in the attached Memorandum of Understanding.
NOW THEREFORE BE IT RESOLVED, That the Homer City Council hereby approves and adopts the Memorandum of Understanding between the City and the English Bay Corporation, a copy of which is attached and incorporated herein.

WHEREAS, Construction of the new Homer ice rink / multi-purpose facility has been a collaborative effort between the Homer Hockey Association, the Arctic Winter Games Host Committee, the English Bay Corporation, and the City of Homer, and
WHEREAS, The partners in this effort were successful in securing a Federal appropriation for Arctic Winter Games transportation improvements; $400,000 of which was earmarked for Homer by the Arctic Winter Games Host Committee, and
WHEREAS, The City and the English Bay Corporation wish to work cooperatively to facilitate the construction of said transportation improvements which will provide more efficient and safe access to the new facility, and
WHEREAS, The City Council approved Ordinance 05-24 on April 25th, 2005 which accepted and appropriated the Federal funding, and
WHEREAS, Ordinance 05-24 appropriated the required local match in the amount of $36,120 with the understanding that the City Manager would attempt to reduce the amount of cash required by contributing in-kind services, construction materials, and private donations to the extent feasible and prudent, and
WHEREAS, The City and the English Bay Corporation recognize that this transportation improvement will provide a benefit to both the public and private sector and wish to evenly split the cost of the required local match, and
WHEREAS, This MOU establishes the respective roles, responsibilities, and obligations of the parties with respect to project management and the required local match.
