RESOLUTION 05-78

A RESOLUTION OF THE CITY COUNCIL NOTING THE SUFFICIENCY OF THE PETITION FOR THE WEST NOVIEW/SOUTH MULLIKIN/SOUTH WRIGHT STREET ROAD RECONSTRUCTION AND PAVING IMPROVEMENT DISTRICT, CREATING THE DISTRICT AND SETTING THE PUBLIC HEARING DATE FOR AUGUST 22, 2005.

WHEREAS, Pursuant to Homer City Code (HCC) 17.04.030(a)(1), property owners of property fronting West Noview/South Mullikin/South Wright Street requested and applied for a Road Reconstruction and Paving Improvement District with signatures in excess of 51% of property owners; and improvements; and

WHEREAS, Pursuant to HCC 17.04.030(a)(2) A neighborhood meeting was held on Thursday, April 14, 2005; and

WHEREAS, Pursuant to HCC 17.04.030(a)(2), a petition was issued on April 20, 2005 to property owners to pursue the road improvements with a deadline of June 20, 2005; and

WHEREAS, Pursuant to HCC 17.04.030(a)(2)(vi), petitioners requested an extension which was granted to July 20, 2005; and

WHEREAS, Pursuant to HCC 17.04.030(b), the petition is found to be sufficient with signatures equaling 68.89% in excess of the required 50% or more.

NOW, THEREFORE, BE IT RESOLVED that the City Council hereby notes the sufficiency of the petition for the West Noview/South Mullikin/South Wright Street Road Reconstruction and Paving Improvement District, finds that these improvements are necessary and should be made, that the petition has sufficient and proper petitioners, that the district is hereby created, that the findings adopted by this Resolution are conclusive and that a public hearing is scheduled for Monday, August 22, 2005 during the scheduled Regular Council meeting.
