A RESOLUTION OF THE HOMER CITY COUNCIL APPROVING THE DEVELOPMENT OF A MEMORANDUM OF UNDERSTANDING WITH THE KACHEMAK BAY CAMPUS OF THE KENAI PENINSULA COLLEGE WHICH WILL ALLOW FOR COOPERATION WITH SAID CAMPUS BY ACCEPTING A PART-TIME EMPLOYEE WHO WILL BE PAID FOR BY THE CAMPUS TO WORK IN THE CITY LIBRARY, for the Campus to use the library facility for its library-related activities AND ACCEPTING BOOKS FROM THE COLLEGE TO SHELVE/CATALOGUE IN THE CITY LIBRARY AND DIRECTING THE CITY MANAGER TO EXECUTE THE APPROPRIATE DOCUMENTS.
WHEREAS, The subject of cooperation between the City library and the Kachemak Bay Campus/Kenai Peninsula College/University of Alaska Anchorage (the College) has been discussed periodically for the last 2 ½ years; and
WHEREAS, Several steps have been taken to smooth the integration of the College's library into Homer's, including both libraries using the same computer SIRSI management system and the College offering to change its catalogue system from the Library of Congress system to the City's Dewey Decimal System; and
WHEREAS, The College has offered to move its collection to Homer's new library, which is 4 ¼ times as large as the existing library, and to provide a half-time person who would be supervised by the City but paid for by the College; and
WHEREAS, Such integration would provide many benefits to Homer students and citizens, including
1. Having books and periodicals available in one location for both students and citizens
2. Integration into the South-Central Regional Library System.
3. Better access to combined collections and reduction of duplication.
4. Reduction in total operating costs and space utilization.
5. On-site access to U. of A. electronic library resources.
and
WHEREAS, With the City library set to open in 8 months the time to make a decision is now, so that planning of the stacks and office layout can take the collaboration into account; and
WHEREAS, A draft Memorandum of Understanding (MOU) between the two parties has been written and is attached.
NOW, THEREFORE BE IT RESOLVED that the Homer City Council approves the development of a
Memorandum of Understanding with the Kachemak Bay Campus of the Kenai Peninsula College which
will allow for cooperation with said campus by accepting a part-time employee who will be paid for by
the college to work in the City Library, for the Campus to use the library facility for its library-related
activities, and accepting books from the college to shelve/catalogue in the City Library, and directing the
City Manager to execute the appropriate documents, and the following:
The City of Homer administration in collaboration with public library personnel and the Kachemak Bay Campus of the Kenai Peninsula College, the University of Alaska, will begin a structuring process and cost benefit analysis and space analysis for significant inclusion of University library services into the new Homer public library facility.
The inclusion is intended to cover a substantial and meaningful amount of print material, full and fair access to online databases, and the use of available university personnel for those services who will be responsible to and supervised by the public library director.
This resolution is intended to provide the general public with equal opportunity and access to any university library services enjoyed by university students or staff in the public library facility.
By no later than July 10th, 2006 the city will submit a satisfactory progress report on this structuring to the city council. By no later than May 20th, 2007 this structuring plan and analysis will be completed and brought to the city at that time for approval and implementation.
PASSED AND ADOPTED By the Homer City Council this 9thday of January, 2006.
Rescinded on February 13, 2006 - this Resolution is annulled and repealed.

This Memorandum of Understanding (MOU), as stated in the Resolution was to be developed, and to, maybe, be considered by the Council in 2007 after a structuring plan and analysis. (See the Now Therefore, Be It Resolved section of the Resolution.)
Memorandum of Understanding
Between City of Homer and Kachemak Bay Campus of Kenai Peninsula College/University of Alaska Anchorage Regarding Cooperation in Library Facilities and Services
1. City of Homer (City) is nearing completion of construction of a 15,000 square foot library, which is 4 ¼ times as large as the existing City library.
2. Kachemak Bay Campus (Campus) of Kenai Peninsula College/University of Alaska Anchorage has a small library facility in its complex and wishes to cooperate with City by housing its current and future books, media and periodicals in the new City Library, which is three blocks from the Campus. Campus will supply a half-time library assistant to work under City supervision in the library in accordance with UA personnel policies and will further re-catalogue its books from the Library of Congress system to the City's Dewey Decimal System. Campus will annually supply additional books and provide access to UAA electronic databases and other related resources.
3. City agrees to allow the Campus to use the library facility for its library-related activities. City will make available 1500 square feet of stack space, 100 sq. feet of processing/storage space and up to 400 square feet of other related space. Reference/circulation areas, computers, study rooms/tables will be shared by both parties. Resources of the two parties will be intermingled and managed in accordance with the SIRSI catalogue system. Campus holdings will be designated accordingly. Utilities will be paid by the City.
4. The City agrees to indemnify and save harmless the University, its Board of Regents, officers, and employees, from and against all claims, demands, judgments, costs and expenses (including reasonable attorney's fees) which may arise by reason of any injury to any person, or damage to any property, attributable to the negligence of the City, its officers, agents and employees, in connections with the City's performance under this agreement. Similarly, the University agrees to indemnify save harmless the City, its officers, and employees, from and against all claims, demands, judgments, costs and expenses (including reasonable attorney's fees) which may arise by reason of any injury to any person, or damage to any property, attributable to the negligence of the University, its officers, agents and employees, in connections with the University's performance under this agreement.
5. This Memorandum may be amended with at least 45 days written notice. It can be terminated by either party with six months notice to the other party.
