RESOLUTION 06-113
A RESOLUTION OF THE CITY COUNCIL ASKING FOR A LEGAL OPINION ON THE FEE STRUCTURE FOR
THE PORT AND HARBOR AREA WITH THE INTENT OF SETTING A DIFFERENT FEE SCHEDULE FOR
HOMER SERVICE AREA RESIDENTS AND THOSE OUTSIDE
WHEREAS, The City of Homer adopted a resolution indicating the intent to comply with GASB accounting rules for
depreciation and reserve balances in the Port and Harbor Enterprise Fund and; and
WHEREAS, Regardless of the operational and accounting separateness of the P+H Enterprise, the city as a whole is
liable and potentially at risk in their bond ratings for non-compliance with GASB rules in the Port and Harbor; and
WHEREAS, The City has made maximum effort to develop and encourage transient summertime commerce on the
Homer Spit and in the port area; and
WHEREAS, The increased municipal costs for supporting transient commerce in the harbor must be borne by the
primary recipients of that service; and
WHEREAS, Local taxpayers help support the city's fiduciary obligations through contributions from their property taxes.
NOW THEREFORE BE IT RESOLVED That the City shall search for precedents and legal mechanisms for imposing a
differential fee schedule on harbor services for users living inside and outside the lower Kenai Peninsula.
