RESOLUTION 06-133



A RESOLUTION OF THE CITY COUNCIL FINDING THE NEED TO CREATE THE OCEAN DRIVE LOOP, PETERSON ADDITION SEWER LOCAL IMPROVEMENT DISTRICT AND SETTING A PUBLIC HEARING FOR MONDAY, NOVEMBER 20, 2006.

WHEREAS, The owners of property fronting Ocean Drive Loop in the Oscar Munson Subdivisions Lots 16-22, 23-A, 25-A, 67-A, 69-73, and Portion of Government Lot 1; and

WHEREAS, Pursuant to Homer City Code (HCC) 17.04.030 the initial request had sufficient and proper signatures to proceed to the petition phase; and

WHEREAS, Pursuant to Homer City Code (HCC) 17.04.040(c), Property Owner Petitioners Waiver, that if there is one hundred percent participation by property owners of the district, such owners may request and give written waiver of notice and right to public hearing and waive the sixty-day objection period; and

WHEREAS, The petition was prepared by the City Clerk and, after review by the Public Works Department Staff, the petition was issued to property owners to obtain signatures; and

WHEREAS, The Property owners requested the waivers believing that they would have 100% participation and wanting to tag onto the Ocean Drive Loop Sewer Improvement Project; and

WHEREAS, All but one property owner signed both the petition and waiver; and

WHEREAS, Since there was not 100% participating and since a neighborhood meeting was not held Pursuant to HCC 17.04.030 prior to the petition phase, a neighborhood meeting was scheduled, noticed and held on Thursday, September 14, 2006 in the City Hall Conference Room; and

WHEREAS, The petition process was conducted pursuant to HCC 17.04.030 with a deadline set of August 19, 2006; and

WHEREAS, Pursuant to HCC 17.04.030 the petition has sufficient and proper signatures equaling 99.4% of property value.

NOW, THEREFORE, BE IT RESOLVED that the City Council hereby finds the need to create the Ocean Drive Loop Sewer Improvement District/Assessment District and sets the date for public hearing as Monday, November 20, 2006 during a Special City Council meeting that begins at 7:00 p.m. for the purpose of hearing protests against the formation of said improvement district.
