A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA NOTING PUBLIC WORKS
ACCEPTANCE OF THE EAST END ROAD(PORTION) SEWER, EAST END ROAD WATER
AND SEWER, HILLSIDE ACRES WATER, HILLSIDE ACRES SEWER, AND THOMPSON
DRIVE SEWER ASSESSMENT/IMPROVEMENT PROJECTS, ACCEPTING THESE
IMPROVEMENTS FOR CITY MAINTENANCE AND FORWARDING THE ASSESSMENT
DISTRICTS TO THE FINAL ASSESSMENT ROLL AND PAYMENT PROCESS AND SETTING
A PUBLIC HEARING DATE OF JULY 24, 2006.
WHEREAS, The East End Road (portion) Sewer Assessment/Improvement District was formed and
construction authorized via Resolution 01-47 adopted on August 13, 2001, with an estimated cost of
$131,154.00, property owner assessments at 50% of project cost with equal shares per parcel
methodology were $8,197.13 per parcel; and
WHEREAS, The East End Road Water and Sewer Assessment/Improvement District was formed and
construction authorized via Resolution 05-07 adopted on January 24, 2005, with an estimated cost of
$325,701.84, property owner assessments at 75% level of project cost with equal shares per parcel
methodology were $15,689.97 for water and $20,721.26 for sewer per parcel; and
WHEREAS, The Hillside Acres Water Assessment/Improvement District was formed and construction
authorized Resolution 01-50 adopted on August 13, 2001 with an estimated cost of $1,410,795.00,
property owner assessments at 50% level of project cost with equal shares per parcel methodology
were $16,795.18; and
WHEREAS, The Hillside Acres Sewer Assessment/Improvement District was formed and construction
authorized via Resolution 02-55(S) adopted on August 26, 2002 with an estimated cost of
$963,000.00, property owner assessments at 50% level of project cost with equal shares per parcel
methodology were $11,464.29; and
WHEREAS, The Thompson Drive Sewer Assessment/Improvement District was formed and
construction authorized via Resolution 02-22 adopted on March 26, 2002 with an estimated cost of
$120,000.00, property owner assessments at 50% level of project cost with equal shares per parcel
methodology were $9,285.71; and
WHEREAS, The improvements were constructed and have been accepted as complete by the Homer
Public Works Department; and

WHEREAS, The final project cost for East End Road (portion) Sewer Improvement is $131,254.57,
50% is $65,627.29 plus 5% administrative cost or $3,281.36 or $68,906.65, there are eight parcels for
equal share property owner assessments of $8,613.33 each which is $416.20 higher than the estimated
assessment or an increase of approximately 5.077% increase; and
WHEREAS, The final project cost for East End Road Water and Sewer Improvement is $269,213.74
for water and $255,061.69 for sewer, 75% water is $201,910.31 plus 5% administrative cost or
$10,095.52 or $212,005.83, there are seventeen parcels for equal share of property owner assessments
of $12,470.93, which is $3,219.04 lower than the estimated assessment for water and 75% sewer is
$191,296.27 plus 5% administrative cost or $9,564.81 or $200,861.08, there are twelve parcels for
equal share of property owner assessments of $16,738.42, which is $3,982.94 lower than the estimated
assessment for sewer; and
WHEREAS, The final project cost for Hillside Acres Water and Sewer Improvement is $1,289,664.00
for water and $930,522.00 for sewer, 50% water is $644,832.00 plus 5% administrative cost or
$32,221.60 or $677,053.60, there are forty three parcels for equal share of property owner assessments
of $15,745.43, which is $1,049.75 lower than the estimated assessment for water and 50% sewer is
$465,261.00 plus 5% administrative cost or $23,263.05 or $488,524.05, there are forty four parcels for
equal share of property owner assessments of $11,102.82, which is $361.47 lower than the estimated
assessment for sewer; and
WHEREAS, The final project cost for Thompson Drive Sewer Improvement is $133,219.67, 50% is $66,609.84 plus 5% administrative cost or $3,330.49 or $69,940.33, there are nine parcels for equal share property owner assessments of $7,771.15 each which is $1,514.56 lower than the estimated assessment; and
WHEREAS, Pursuant to HCC §17.04.070 at any time after project completion and acceptance, the
Council shall assess the properties benefitted their proportionate share of the cost of the improvement
and that there will be a public hearing; and
WHEREAS, There is a property owner request from Arn and Kathy Johnson that the Council honor
the previous rule for subdividing after a project is completed, which was changed via Ordinance 02-48
adopted on December 9, 2002, effective December 10, 2002 and since the Hillside Acres Sewer district
was authorized for construction August 2002 and the Water district was authorized for construction
August 2001; and
WHEREAS, Beverly J. Savory has requested, since 2002, that the Council consider her financial
situation and provide for deferment due to disability.

NOW THEREFORE BE IT RESOLVED, by the City Council of Homer, Alaska hereby noting Public
Works acceptance of the East End Road (portion) Sewer, East End Road Water and Sewer, Hillside
Acres Water, Hillside Acres Sewer, and Thompson Drive Sewer Assessment/Improvement Projects,
accepting these improvements for City maintenance and forwarding the assessment district to the final
assessment roll and payment process and setting a public hearing date of July 24, 2006; and
BE IT FURTHER RESOLVED by the City Council that the Administration will come back to the City
Council with a plan and/or agreement with Kachemak City regarding the assessments for water and
sewer that were extended to Kachemak City via the East End Road Water and Sewer Improvement
District Project; and
BE IT FURTHER RESOLVED, by the City Council that consideration will be given to Arn and Kathy
Johnson regarding subdividing as was provided in the Forest Glen Subdivision; and
BE IT FURTHER RESOLVED, by the City Council that due consideration will be given to deferred
assessments for Beverly Savory and the recommended deferred assessments for the offsite water
extensions as noted in Memorandum 06-99.
