                                                            RESOLUTION 07-03                           Advisory Commission

A RESOLUTION OF THE CITY COUNCIL, ADOPTING AN EMERALD PARK MASTER PLAN WHICH SHALL BE TO LEAVE THE LAND IN ITS NATURAL STATE.

            WHEREAS, Lot 1B Emerald Park was deeded to the City by the original subdivider, Nick Gangle; and

 

            WHEREAS, Due to a plat note on the Emerald Highland Estates Subdivision Unit 3, the city does not have clear title to develop the parcel as a public park; and

           

            WHEREAS, Resolution 04-24(A) directed staff to work on resolving any restrictions on the park in the Emerald Highland Estates Subdivision so that the City could move forward and develop the park; and

 

            WHEREAS, The Parks and Recreation Advisory Commission held a public hearing on February 16th 2006 for affected property owners to discuss the title issues and resolution, and asking for their input on development of a public park; and

 

WHEREAS, Some neighborhood residents at that time expressed a desire for the lot to remain in a natural state, as it appears to be a wildlife corridor; and

 

WHEREAS, The neighborhood residents requested additional time to discuss the development of the park as a neighborhood, and then meet again with the Commission, prior to signing any quitclaim documents; and

 

            WHEREAS, The Commission again invited property owners to speak to the Commission on November 16, 2006 on a park plan; and

 

            WHEREAS, Property owners were reluctant to sign any documents releasing the property without some assurance that the future land use shall remain green space with a recognition of the wildlife corridor, and local traffic on Highland would not increase; and

 

WHEREAS, The park lot has wetlands, is generally sloping, contains a creek, and is not a highly developable lot.

 

            NOW, THEREFORE, BE IT RESOLVED That the master plan for Emerald Park shall be to leave the land in its natural state; and

 

            BE IT FURTHER RESOLVED That no city maintenance of this parcel shall occur unless to correct unsafe conditions or to plant new trees, until such time that the City has clear title to

the land.

            PASSED AND ADOPTED by the Homer City Council this _____ day of January 2007.
