RESOLUTION 07-111

 

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA NOTING PUBLIC WORKS ACCEPTANCE OF THE KACHEMAK DRIVE PHASE I WATER AND SEWER IMPROVEMENT PROJECT, ACCEPTING THIS PROJECT FOR CITY MAINTENANCE AND FORWARDING THE ASSESSMENT DISTRICT TO THE FINAL ASSESSMENT ROLL AND PAYMENT PROCESS AND SETTING A PUBLIC HEARING DATE OF MARCH 10, 2008.

 

            WHEREAS, The Kachemak Drive Phase I Water and Sewer Improvement Districts were created via Resolution 04-11 on January 12, 2004 and Resolution 05-80 July 25, 2005; and

 

            WHEREAS, The Kachemak Drive Phase I Water and Sewer Improvement/Assessment District was formed and the City Manager authorized to proceed with the preparation and construction of the improvements via Resolution 06-139 adopted on December 11, 2006; and

 

            WHEREAS, The improvements were constructed and have been accepted as complete by the Homer Public Works Department in the final amount of $1,171,224.00; and

 

            WHEREAS, Pursuant to HCC §17.04.070 at any time after project completion and acceptance, the Council shall assess the properties benefited their proportionate share of the cost of the improvement and that there will be a public hearing.

 

            NOW, THEREFORE, BE IT RESOLVED by the City Council of Homer, Alaska hereby noting Public Works acceptance of the Kachemak Drive Phase I Water and Sewer Improvement Project as complete, accepting this project for City maintenance and that this assessment district is hereby forwarded to the final assessment roll and payment process and setting a date of March 10, 2008 for public hearing.

 

            PASSED AND ADOPTED BY THE HOMER CITY COUNCIL this 26th day of November, 2007.
