RESOLUTION 07-56

 

A RESOLUTION OF THE HOMER CITY COUNCIL APPROVING A NEW FIVE YEAR LEASE AGREEMENT WITH THE PIER ONE THEATRE.

 

            WHEREAS, The Lease Agreement between the City of Homer and the Pier One Theatre expired on December 9, 2006; and

 

            WHEREAS, Pier One Theatre has requested that the lease be renewed under the same terms of the previous lease; and

 

            WHEREAS, In the prior lease agreement, the term was five years, the rent $1.00 per year, and the permitted use was operating a summer stock theatre and related activities and winter storage; and

 

            WHEREAS, The Lease Committee has reviewed this request and recommends approval of a new lease at the same terms and conditions; and

 

            WHEREAS, Chapter 7.2 (4) of the Property Management Policy and Procedures (Lease Policies) states “The Council may approve a lease of City land for less than fair market rent, minimum rent, or uniform rental rate only if the motion approving the lease contains a finding that the lease is for a valuable public purpose or use, and a statement identifying such purpose or use”; and

 

            WHEREAS, Homer City Council Resolution 89-36-(A) provides that “Be it resolved by the Common Council of the City of Homer, Alaska that the recreational / parking designation as indicated in the Spit Interim Plan is hereby acknowledged and continued for such period of time as sport fishing in the lagoon and the summer theatre activities at that location continue.

 

            NOW, THEREFORE, BE IT RESOLVED, that the Homer City Council hereby finds that leasing land to the Pier One Theatre for less than fair market rent serves a valuable public purpose because Pier One is a non-profit organization that promotes culture and the arts, contributes to the economy, and enhances the recreational and visitor environment on the Homer Spit; and

 

            BE IT FURTHER RESOLVED, that the Council hereby approved a new lease agreement between the City and the Pier One Theatre, a copy of which is attached and incorporated herein, and authorizes the City Manager to execute the appropriate documents.

 

            PASSED AND APPROVED by the Homer City Council this 9th day of April, 2007.
