RESOLUTION 07-84

 

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA IN SUPPORT OF RETAINING THE TEN-ACRE PARCEL ADJACENT TO KAREN HORNADAY PARK, KENAI PENINSULA BOROUGH PARCEL NUMBER 17504003, UNTIL SUCH TIME AS THERE ARE STEEP SLOPE REGULATIONS IN PLACE AND THERE IS LEGAL ACCESS TO THE LAND SO THE FULL MARKET VALUE AND PUBLIC INTEREST ARE KNOWN.

            WHEREAS, Steep slope development is a safety and aesthetic concern; and

            WHEREAS,  Homer continues to develop and experience high real estate values, and people are developing more marginal properties that are more difficult and expensive to develop; and

WHEREAS, It is crucial to create rules to ensure the health, welfare and safety of residents by enacting steep slope development regulations; and

 

WHEREAS, There is no legal access to the property, so it is difficult to fully assess the value of this south facing view property; and

 

WHEREAS, There have been two recent proposals by private parties interested in acquiring the land through a land trade which have both been rejected by the Council; and

 

WHEREAS, The 1999 Comprehensive Plan Update states “Identify and Plan for future parks and recreational needs in the City for both residents and visitors,” and it is a valuable trail connector; and

 

WHEREAS, The City does not generally purchase land for recreational or green space purposes and does not have the funding to purchase scenic hillside view property for public enjoyment.

 

            NOW, THEREFORE, BE IT RESOLVED that the City Council of Homer, Alaska hereby supports retaining the ten-acre parcel adjacent to Karen Hornaday Park, Kenai Peninsula Borough Parcel Number 17504003, until such time as steep slope regulations are in place and legal access is created and the full market value of the land and public interest can be fairly considered by the public.           

 

            PASSED AND ADOPTED by the City Council of Homer, Alaska this 13th day of August, 2007.
