RESOLUTION 07-89(A)

 

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA APPROVING A PURCHASE AGREEMENT AND AUTHORIZING THE EXCHANGE OF FOUR CITY OWNED PARCELS CONTAINING 10 ACRES LOCATED NEAR THE HOMER BOAT YARD AND KACHEMAK DRIVE (PARCEL NUMBERS 179-080-09, 15, 25, 26) FOR A PORTION OF A PARCEL OF LAND (TAX ID 173-053-08) OF EQUIVALENT VALUE ADJACENT TO THE WATER TREATMENT PLANT, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE APPROPRIATE DOCUMENTS. 

 

            WHEREAS, HCC 18.06.075 (A) provides that property needed for a public purpose may be acquired by the City through trade or exchange of other City real property no longer needed for a public purpose; and

 

            WHEREAS, HCC 18.06.075 (B) provides that the terms of any such transaction shall be affixed by resolution of the City Council and that prior to closing the transaction, the City Council shall make findings by resolution that the property to be acquired is needed for a public purpose and that the property to be conveyed in the trade or exchange is no longer needed for a public purpose; and

 

            WHEREAS, Constructing a new water treatment plant is a very important capital improvement priority for the City and this improvement is directly related to the public health, safety, and welfare; and

 

            WHEREAS, It has been determined by the City staff and the City’s engineering consultants that parcel number 173-053-08 is the only feasible and prudent location for the new treatment plant; and

 

            WHEREAS, The owner of parcel 173-053-08 has indicated that she is not interested in a cash sale at this time and would prefer a trade for the parcels identified herein.

 

            NOW, THEREFORE, BE IT RESOLVED, that the Homer City Council finds that the lot proposed to be acquired in the attached purchase agreement is needed for a public purpose, that the City owned lots proposed for exchange are classified undesignated in the City Land Allocation Plan and not needed for a public purpose, and that the proposed purchase agreement is in the public interest.

 

            BE IT FURTHER RESOLVED, that the Council hereby approves the proposed purchase agreement, a copy of which is attached and incorporated herein, and authorizes the City Manager to execute the appropriate documents.

 

                        PASSED AND APPROVED by the Homer City Council this 27th day of August, 2007.
