RESOLUTION 08-04(S)

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, APPROVING THE PROPOSED NEW SUBLEASE AND OPERATING AGREEMENT BETWEEN THE KENAI PENINSULA BOROUGH AND THE SOUTH PENINSULA HOSPITAL OPERATING BOARD.

WHEREAS, The ground lease between the City of Homer and the Kenai Peninsula Borough for the South Peninsula Hospital facility contains a provision that all subleases must be approved by the City; and

WHEREAS, The Operating Agreement between the Borough and the South Peninsula Hospital Operating Board is considered to be a sublease; and

WHEREAS, The Borough and the Operating Board have been negotiating the terms and conditions of a new Operating Agreement over the past few months and the parties have reached agreement on a new pact; and

WHEREAS, The new draft agreement has the support of the Borough Administration, has been endorsed by the Operating Board and currently under review by the South Peninsula Hospital Service Area Board; and

WHEREAS, The Borough Assembly has introduced Ordinance 2007-41 which authorizes Mayor Williams to execute this agreement and hearings are scheduled for both January 8 and January 22, 2008.

NOW, THEREFORE, BE IT RESOLVED that the Homer City Council hereby approves the Draft Sublease and Operating Agreement between the Kenai Peninsula Borough and the South Peninsula Hospital Operating Board.
