RESOLUTION 08-103

A RESOLUTION OF THE HOMER CITY COUNCIL EXEMPTING THE COTTONWOOD HORSE PARK FROM ALL CITY PROPERTY TAX MEETING THE CRITERIA OF KENAI PENINSULA BOROUGH CODE 5.12.100, REAL PROPERTY TAX - EXEMPTIONS - COMMUNITY PURPOSE PROPERTY - CONDITIONS, RETROACTIVE TO JANUARY 1, 2008 AND AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL ASSOCIATED DOCUMENTS.

 

            WHEREAS, The Cottonwood Horse Park is a multi-use park and riding facility that nurtures and educates equine enthusiasts within the community; and

 

            WHEREAS, The Cottonwood Horse Park promotes and encourages activities in the community through educational, recreational, therapeutic, and youth programs; and

 

            WHEREAS, The Cottonwood Horse Park has received the Kenai Peninsula Borough tax exemption; and

 

            WHEREAS, This exemption was provided for under Kenai Peninsula Borough Code 5.12.100, Real Property Tax - Exemptions - Community Purpose Property - Conditions; and

 

            WHEREAS, Cottonwood Horse Park, owned by Kachemak Bay Equestrian Association, a non-profit organization requests formal exemption from the City to address the change in property tax status.

 

            NOW, THEREFORE, BE IT RESOLVED that the Homer City Council hereby exempts the Cottonwood Horse Park from all City Property Tax meeting the criteria of Kenai Peninsula Borough Code 5.12.100, Real Property Tax - Exemptions - Community Purpose Property - Conditions, retroactive to January 1, 2008 and that the City Manager is hereby authorized to execute any and all associated documents.

 

            PASSED AND ADOPTED by the City Council of Homer, Alaska this 22nd day of September, 2008.
