RESOLUTION 08-119

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, AMENDING KACHEMAK DRIVE PHASE I WATER AND SEWER IMPROVEMENTS ASSESSMENT ROLL EXEMPTING LOT 01 BLK 300, KENAI PENINSULA BOROUGH PARCEL NO. 179-401-04 LEASED BY THE ALASKA DEPARTMENT OF FISH AND GAME (ADF&G) ON WHICH THE WILDLIFE VIEWING PLATFORM IS BUILT.

WHEREAS, Resolution 04-11 was adopted by Council on January 12, 2004 authorizing the formation of the Kachemak Drive Phase I Sewer Improvement District; and

   WEREAS, Pursuant to Resolution 05-50(A) which states the Council can exempt certain lands that will not be developed due to conservation easements or owned by organizations that conserve land for public purposes and or habitat protection from the Homer Accelerated Water and Sewer Program Assessment District Assessments on a case by case basis; and

WHEREAS, Lot 01, Blk 300, Kenai Peninsula Borough Parcel No. 179-401-04, across from the Homer Airport Terminal is owned by the Alaska Department of Transportation and the lease is held by the Alaska Department of Fish and Game for the purpose of the viewing platform; and

WHEREAS, ADF&G, Boy Scouts and the City of Homer entered into an agreement in June 1995 to provide the land, construct and maintain the viewing platform with many organizations donating funds including a significant amount from Ducks Unlimited; and

WHEREAS, The viewing platform benefits Homer residents, school children, and visitors as they observe moose, waterfowl and other wildlife which may not be easily seen other places; and

            NOW, THEREFORE, BE IT RESOLVED that Lot 01, Blk 300, Kenai Peninsula Borough Parcel No. 179-401-04 will be exempt from the assessed amount on the Kachemak Drive Phase I Water and Sewer Assessment District.

 

            PASSED AND ADOPTED by the Homer City Council on this 24th day of November, 2008.
