RESOLUTION 08-26

 

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, URGING THE UNITED STATES HOUSE OF REPRESENTATIVES OR THE JOINT HOUSE-SENATE LEADERSHIP TO CREATE A SELECT COMMITTEE TO INVESTIGATE THE PRESIDENTIAL ADMINISTRATION AND TO MAKE RECOMMENDATIONS REGARDING GROUNDS FOR POSSIBLE IMPEACHMENT.

 

            WHEREAS, The American people require and expect that their highest officials be subject to the laws of the land like any citizen, most particularly under the constitutional oath taken by them upon assuming office; and

 

            WHEREAS, Substantial evidence has been gathered that appears to indicate that President George W. Bush and Vice President Richard Cheney have committed high crimes and misdemeanors; and

 

            WHEREAS, Said high crimes and misdemeanors include, but may not be limited to:

 

Conspiracy to defraud the United States, in knowingly misleading Congress and the American people regarding Iraq's alleged weapons of mass destruction and ties to al Qaeda, as a pretext for leading our nation into war; and

 

Violating international treaties to which the United States is a signatory and legally bound, in particular the Geneva Conventions, in the use of torture/extreme interrogation and extraordinary rendition; and

 

Violating the constitutional amendment against unreasonable searches and seizures, in engaging in wiretapping without a warrant on American citizens and otherwise violating citizens' right to privacy; and

 

Willfully and maliciously revealing the identify of a U.S. covert operative in violation of the Intelligence Identities Protection Act; and

 

Conducting or suborning other federal employees to conduct political activities on government property, in violation of the Hatch Act; and

 

Specifically in the case of the president, refusing to produce information requested as part of Congress' oversight authority, in violation of the Presidential Records Act and in defiance of the constitutional separation of powers; and

 

Specifically in the case of the president, declaring in his signing statements of legislation passed by Congress his intention to disregard his constitutional duty to faithfully execute the laws of the United States; and

 

            WHEREAS, The result of some of the above-listed actions has undermined the Constitution of the United States and its protections that are the foundation of our democracy and civil liberties, has compromised our security by damaging our international reputation as a defender of human rights and the rule of law, and has ballooned the national debt, with concomitant loss to local governments of federal financial support for local infrastructure and other programs; and

 

            WHEREAS, Congress has begun the process of holding hearings to examine several of these charges; and

 

            WHEREAS, the Rules of the House of Representatives call for the referral of possible articles of impeachment to the Judiciary Committee for investigation; and

 

            WHEREAS, Petitions from the country at large may be presented by the Speaker of the House according to Clause 3 of House Rule XII.

 

            NOW, THEREFORE, BE IT RESOLVED that the Citizens of Homer and the Homer City Council believe that there is sufficient evidence to commence hearings in the House of Representatives that may lead to the formation of a select committee to make recommendations regarding grounds for impeachment of either or both President George W. Bush and Vice President Richard B. Cheney. 

 

            BE IT FURTHER RESOLVED that the Clerk of the City of Homer be, and is hereby, instructed to certify to the Speaker of the House of Representatives, each member of the Judiciary Committee of the U.S. House of Representatives, and Alaska’s Congressional Delegation, under the seal of the City of Homer, a copy of this resolution and its adoption by the City of Homer, as a memorial, and request that this memorial be delivered to the Office of the Congressional Clerk and entered in the United States Congressional Journal. The copies shall be marked with the word "Memorial" at the top of the document and contain the original authorizing signature of the mayor and clerk of Homer.

 

            PASSED AND ADOPTED by the Homer City Council this 25th day of February, 2008.
