A RESOLUTION OF THE
HOMER CITY COUNCIL AMENDING RESOLUTION
08-106(A) CONFIRMING THE ASSESSMENT ROLL FOR
THE SPRUCEVIEW AND WEST NOVIEW ROAD
RECONSTRUCTION AND PAVING ASSESSMENT
DISTRICT TO PROVIDE FOR A DEFERRED ASSESSMENT FOR THE PRATT MUSEUM.
WHEREAS, On October
13, 2008, the Homer City Council adopted Resolution
08-106(A) confirming the assessment roll for the Spruceview and West Noview
Road Reconstruction and Paving Assessment District (“District”), and
establishing payment dates and other terms for the assessments; and
WHEREAS, The Pratt Museum had made a timely application for a deferral
of its assessment in the District under HCC
17.04.160, as its property fronted on two streets and it presently has no
access to Spruceview Avenue; and
WHEREAS, While HCC 17.04.160
appears to authorize an assessment deferral only where a lot fronts on two
streets, both located in the assessment district, and but for the deferral
would be subject to a double front footage assessment, HCC
17.04.160 in the past had been interpreted to allow an assessment deferral in
situations similar to that of the Pratt Museum, and the Pratt Museum joined in
the petition for the District only after being advised that it would be
eligible for an assessment deferral; and
WHEREAS, The Pratt Museum has stated its willingness to pay its
assessment in full on April
1, 2012 if it is allowed to defer payment until that time; and
WHEREAS, HCC 17.04.090 authorizes
the Council to fix the time of payment of assessments by resolution at the time
the assessment roll is confirmed; and
WHEREAS, Based on the facts and circumstances described above, the
Council finds that it is in the public interest to amend Resolution 08-106(A)
to defer the Pratt Museum’s
assessment until April 1,
2012, when it will be due in full.
NOW, THEREFORE, BE IT RESOLVED that Resolution 08-106(A) is amended to
provide that the assessment levied on the property of the Pratt
Museum (KPB Parcel 175-101-22)
shall be due and payable in full on April 1, 2012.
