RESOLUTION 09-100
A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, APPROVING A SHORT TERM, ATYPICAL LEASE FOR A TERM NOT TO EXCEED ONE YEAR ON LOT 13B WITH SNUG HARBOR SEAFOODS FOR THE PURPOSE OF OPERATING A FISH BUYING STATION.
WHEREAS, The City of Homer recently issued a Request for Proposals to lease fifteen parcels on the Homer Spit and the submittal deadline was May 8, 2009; and
WHEREAS, Lot 13B was one of the parcels offered for lease and no proposals were received; and
WHEREAS, Snug Harbor Seafoods has been operating a fish buying station on one half of Lot 13B for the past few years under a series of short term leases and equipment storage agreements; and
WHEREAS, Chapter 11, Section G of the City Lease Policies provides that short term leases of no more than six months can be approved but that no consecutive short term leases for the same property to the same lessee may be issued without the approval of the City Council; and
WHEREAS, Snug Harbor has indicated that it would like to enter into a longer term lease but that it does not presently have the resources to make the type of capital investment the City would prefer and therefore, did not submit a proposal for long term development; and
WHEREAS, Both the Lease Committee and the Port and Harbor Commission have discussed this issue and have concluded that even though Snug Harbor is not making the type of long term capital investment preferred by the City, there is still a significant economic benefit which accrues to the community by having them here and concluded that the City should make a longer term lease available; and
WHEREAS, At its regular meeting on July 9, 2009, the Lease Committee adopted the following motion:
THE LEASE COMMITTEE RECOMMENDS THAT CITY COUNCIL DIRECT THE CITY MANAGER TO ENTER INTO LEASE NEGOTIATIONS WITH SNUG HARBOR AND THAT THE LEASE BE NO LONGER THAN ONE YEAR IN DURATION.
NOW, THEREFORE, BE IT RESOLVED that the Homer City Council hereby approves an atypical lease (consecutive short term leases) with Snug Harbor Seafoods and authorizes the City Manager to negotiate the terms of a lease not to exceed one year in duration.
