RESOLUTION 09-127(A)

 

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, APPROVING THE EXTENSION AND AMENDMENT OF THE LEASE BETWEEN THE CITY OF HOMER AND THE UNIVERSITY OF ALASKA, ANCHORAGE, KACHEMAK BAY CAMPUS, FOR THE FORMER HOMER INTERMEDIATE SCHOOL.

 

            WHEREAS, The term of the lease between the City of Homer and the University of Alaska, Anchorage, Kachemak Bay Campus, expires on September 30, 2009; and

 

            WHEREAS, The City and the University wish to extend and amend the lease for an additional 16 month term commencing on October 1, 2009 and terminating on January 31, 2011 with a month to month renewal option up to July 31, 2011; and

 

            WHEREAS, The City and the University have agreed to a base monthly rent of $6,571.67 for the months October 1, 2009 through June 30, 2010 and $7,170.83 for the months July 1, 2010 through January 31, 2011 (annual rent $82,455 in 2010); and

 

            WHEREAS, The base rent is inclusive of all utility costs allocated based on the square footage of the building used by the college, (water, sewer, electric, heating fuel) up to $2,500 per month. Utility costs exceeding that amount are the responsibility of the University.

 

            NOW THEREFORE BE IT RESOLVED that the Homer City Council hereby approves the extension and amendment (Amendment Number 1) between the City and the University of Alaska for use of the old Homer Intermediate School, a copy of which is attached and incorporated herein.

 

            PASSED AND ADOPTED by the Homer City Council this 14th day of December, 2009.
