RESOLUTION OF THE
WHEREAS, Payment in Lieu of Taxes (PILT) are federal payments to local governments that help to offset losses in property taxes due to nontaxable federal lands located within their boundaries; and
WHEREAS, PILT payments are intended to help local governments provide basic public services including police protection, fire fighting, emergency medical, search and rescue, public works, and schools; and
WHEREAS, The Kenai Peninsula Borough is the local government recipient of annual PILT payments and it received $1,899,376 in Fiscal Year 2008; and
WHEREAS, The Department of Interior issued additional 2008 PILT funding to eligible counties and jurisdictions under the recently enacted Emergency Economic Stabilization Act of 2008 (Public Law 110-343); and
WHEREAS, The Borough was notified that it will receive an additional $1,152,533 in 2008, bringing the total PILT payment to $3,051,929; and
WHEREAS, The Borough Administration, in announcing this additional PILT funding to the Assembly, described the money as “This is General Fund Revenue and can be spent wherever directed by the Administration and Assembly” (Narrative Report #5); and
WHEREAS, Cities within the Borough contain significant amounts of nontaxable federal property and should also be eligible for relief; and
WHEREAS, Cities within the Borough provide a large proportion of the basic public services enjoyed by Borough residents including many services that the Borough does not; and
WHEREAS, Cities within the Borough provide many services that are area-wide in nature and are utilized by Borough residents living outside of city corporate boundaries, such as libraries, recreation, youth services, funding for vital non-profit services, and animal control.
NOW, THERFORE, BE IT RESOLVED,that the Homer City Council hereby requests that the Kenai Peninsula Borough share Federal PILT payments with Cities within the Borough (A Borough Revenue Sharing Plan) and that it work with the Cities to develop a fair and proportionate revenue distribution formula.
BE IT FURTHER RESOLVED that the Council requests that copies of this resolution be forwarded to Mayor Carey, Assembly President Milli Martin, Assembly Member Bill Smith, and to the Mayors of all Cities within the Borough.
