RESOLUTION 09-28

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, ADDING TWO PROPERTIES TO THE KACHEMAK DRIVE WATER/ SEWER PROJECT (PHASE II) LOCAL IMPROVEMENT DISTRICT.

            WHEREAS, The Council has adopted Resolution 05-81(S) on July 25, 2005 which authorized the formation of the Kachemak Drive Water and Sewer Project (Phase II) LID assessment district after a majority of property owners within the LID boundaries supported the creation of an LID; and

            WHEREAS, During the design of the project and after attending neighborhood meetings, two property owners have requested to be added to the LID; and

WHEREAS, Public Works concludes that these properties can effectively and efficiently be served with water and sewer as part of the project, and that adding these properties to the LID will not increase the cost to those already within the LID,

NOW, THEREFORE, BE IT RESOLVED that the Homer City Council formally expands the boundaries of the Kachemak Drive (Phase II) Water/Sewer LID to include the following two properties (as shown on the attached map – Attachment A):

1) RANKIN SUBDIVISION, LOT 1, T 6S R 13W SEC 23 SEWARD MERIDIAN; KPB TAX ID #17915069;

2) A PORTION E1/2 SE1/4 BOUNDED ON THE WEST BY KACHEMAK DRIVE; THE H. K. DAVIS SUBDIVISION TRACT A & LEE COLE SUBDIVISION, TRACT B; ON THE NORTH BY EAST RD; ON THE EAST BY SEAL ROCK ROOST SUBDIVISION, TRACT 1, AND ON THE SOUTH BY ATS 644, T 6S R 13W SEC 11 SEWARD MERIDIAN; KPB TAX ID# 17421024

            PASSED AND ADOPTED by the Homer City Council this 23rd day of February, 2009.
