RESOLUTION 09-54

 

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, DECLARING THAT LOTS 43, 44, AND 79, OSCAR MUNSON SUBDIVISION, AND LOT 2, HOMER PUBLIC LIBRARY SUBDIVISION NUMBER 2, ARE NO LONGER NEEDED FOR A PUBLIC PURPOSE AND AUTHORIZING THE CITY MANAGER TO TAKE THE APPROPRIATE STEPS TO MAKE THEM AVAILABLE IN A PUBLIC SALE.

 

            WHEREAS, During its recent review of the City Land Allocation Plan, the Council determined that Lots 43, 44, and 79, Oscar Munson Subdivision and Lot 2, Homer Public Library Subdivision Number 2 were not needed for a public purpose and should be offered to the public for sale ( Resolution 09-33(A)); and

 

            WHEREAS, HCC 18.12.010 provides that real property no longer required for a public purpose may be sold to the highest responsible bidder at a public auction sale or by sealed bids; and

 

            WHEREAS, HCC 18.12.020 requires that City land may not be sold for less than fair market value and that an appraisal must be completed not longer than six months prior to the sale; and

 

            WHEREAS, HCC 18.12.030 states that the City Council in the resolution authorizing the sale of real property shall set forth the terms and conditions of the public sale.

 

            NOW, THEREFORE, BE IT RESOLVED that the Homer City Council hereby declares that Lots 43, 44, and 79 Oscar Munson Subdivision and Lot 2, Homer Public Library Subdivision No. 2 are no longer needed for a public purpose.

 

            BE IT FURTHER RESOLVED that the Council authorizes the City Manager to take the necessary steps to offer these parcels in a public sale including conducting the required appraisals and preparing the resolution containing the terms and conditions of the sale for Council approval.

 

            PASSED AND ADOPTED by the Homer City Council this 26th day of May, 2009.
