RESOLUTION 09-55
A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, AUTHORIZING THE CITY MANAGER TO INITIATE ROAD, WATER AND SEWER LOCAL IMPROVEMENT DISTRICTS (LIDS) WITHIN THE LILLIAN WALLI ESTATES SUBDIVISION.
WHEREAS, Lots within the Lillian Walli Estates Subdivision cannot presently be developed because the original subdivider did not adhere to the Subdivision Agreement and construct roads, water, and sewer lines within the subdivision prior to selling individual lots; and
WHEREAS, A number of property owners have contacted the City expressing a willingness to participate in an LID so that they can move forward with developing their property; and
WHEREAS, The City of Homer owns eight lots within the Subdivision and the Council wishes to put them on the market and get them on the tax roles; and
WHEREAS, Constructing roads and water and sewer utilities within this subdivision is in the public interest and advances Council priorities because it would increase the tax base, promote in-filling, and provide more customers for the water and sewer utility; and
WHEREAS, HCC 17.04.030 (d) provides that the City Council may determine that an improvement is needed and initiate a local improvement district by passing a resolution by approval of not fewer than three fourths vote of the council so declaring and shall proceed as provided in Sections 17.04.040 through 17.04.060 of this Chapter; and
WHEREAS, Prior to Council consideration of a resolution of the type described above, it is necessary and desirable for the City Administration to prepare a draft, preliminary development plan that contains such things as the proposed LID boundaries, the extent of improvements, the assessment methodology, the property owners and assessed valuations, and the estimated project cost.
NOW, THEREFORE, BE IT RESOLVED that the Homer City Council finds that it is in the public interest to construct roads and water and sewer lines within the Lillain Walli Estates Subdivision because it will promote economic growth, expand the tax roles, promote in-filling, and provide more customers for the water and sewer utility.
BE IT FURTHER RESOLVED the Council finds that City initiated LIDs are warranted due to the complicated legal status of this subdivision and the fact that installing necessary improvements is cost prohibitive for individual lot owners.
BE IT FURTHER RESOLVED that the Council hereby authorizes the City Manager to prepare a preliminary development plan for consideration by the Council and by the property owners within the proposed LID.
