RESOLUTION 09-69
A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, APPROVING A MUTUAL AID AGREEMENT BETWEEN THE CITY AND THE KENAI PENINSULA BOROUGH ON BEHALF OF THE KACHEMAK EMERGENCY SERVICES AREA.
WHEREAS, AS 29.35.010 (13) authorizes the City and the Kenai Peninsula Borough (Borough), on behalf of its service areas, to enter into an agreement, including an agreement for cooperative or joint administration of any function or power, with another municipality; and
WHEREAS, The City and the Borough, on behalf of the Kachemak Emergency Services Area (KESA), are currently operating under a contract entitled “Agreement Regarding the Provision of Fire and Emergency Medical Services” which contained provisions for a gradual transition to independent status for KESA; and
WHEREAS, The contract between the City and the Borough became effective on January 1, 2008 and had a term of a minimum of two years but could be terminated early if the Borough determined that KESA was prepared to independently assume full responsibility for providing fire and emergency medical services within the service area; and
WHEREAS, The Borough and KESA recently informed the City that KESA was prepared to assume full responsibility for providing fire and emergency medical services within the service area and that they intended to terminate the contract effective June 30, 2009; and
WHEREAS, The City, Borough, and KESA administrations have been working together to plan for the transition, including drafting a new mutual aid agreement between the parties; and
WHEREAS, The purpose of the proposed Mutual Aid Agreement is to establish procedures and standards to enable the Homer Volunteer Fire Department and KESA to assist each other in responding to emergencies.
NOW, THEREFORE. BE IT RESOLVED that the Homer City Council hereby approves the attached Mutual Aid Agreement between the City and the Borough, on behalf of the Kachemak Emergency Services Area, a copy of which is attached and incorporated herein.
