RESOLUTION 09-75

 

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA APPROVING THE LONG TERM LEASING OF LOT 21, HOMER SPIT SUBDIVISION NO. 5 TO THE SELDOVIA VILLAGE TRIBE FOR A FERRY STAGING / LOADING AREA, AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE THE TERMS OF THE LEASE AND RELATED AGREEMENTS.

 

            WHEREAS, The City of Homer recently issued a request for proposals to lease fifteen parcels on the Spit and the deadline for proposal submittal was May 8, 2009; and

 

            WHEREAS, The Seldovia Village Tribe submitted a proposal to lease Lot 21, Homer Spit Subdivision No. 5 for the purpose of constructing the Kachemak Bay Ferry terminal staging and loading facility; and

 

            WHEREAS, Seldovia Village Tribe also proposes to operate a ferry between Homer and Seldovia, to pay all applicable taxes and fees, and to make certain improvements including a loading pier and gangways that will benefit the harbor and harbor users as a whole and ultimately become the property of the City; and

 

            WHEREAS, The Lease Committee reviewed the proposal at its meetings on May 18, July 9, and July 15, 2009 and the Port and Harbor Commission reviewed the proposal at its meeting on May 27, 2009; and

 

            WHEREAS, The Lease Committee finds that the proposal is responsive to the RFP, that it is in the overall best interest of the City, and adopted the following motion:

 

THE LEASE COMMMITTEE RECOMMENDS THAT THE HOMER CITY COUNCIL AUTHORIZE THE CITY MANAGER TO NEGOTIATE A LEASE WITH SELDOVIA VILLAGE TRIBE FOR LOT 21 AND TO WORK TO SECURE ALL NECESSARY AGREEMENTS AND MEMORANDUMS OF UNDERSTANDING FOR THE PROPOSED RAMP ACCESS AND THE LOADING PIER AT JJ FLOAT AS THEY WILL EVENTUALLY BECOME CITY PROPERTY.

 

            NOW, THEREFORE, BE IT RESOLVED that the Homer City Council hereby approves the long term leasing of Lot 21, Homer Spit Subdivision No. 5, to the Seldovia Native Tribe for a ferry staging and loading area as described in the Seldovia Native Tribe’s proposal, a copy of which is attached and incorporated herein, subject to the negotiation of satisfactory lease and related agreement terms, and authorizes the City Manager to negotiate the terms of the lease and related agreements.

 

            PASSED AND ADOPTED by the Homer City Council this 27th day of July, 2009.

Fiscal Note: $7,525.00 annual lease revenues, $3,104.35 annual moorage revenues, plus sales and property tax.
