RESOLUTION 09-76(S)

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, APPROVING A REQUEST BY HOMER ENTERPRISES, LLC TO SUBLEASE AN EXISTING BUILDING ON LEASED LAND TO HOMER SHIPPING CENTER AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE THE NECESSARY LEASE AMENDMENT.

WHEREAS, Homer Enterprises, LLC has formally requested that it be permitted to sublease an existing building on leased land to Homer Shipping Center; and

WHEREAS, The proposed sub-lessee, Homer Shipping Center would engage in shipping activities, primarily fish, which is consistent with and complimentary to the permitted uses in the base lease (the Sport Shed); and

WHEREAS, The Lease Committee reviewed this application at its meetings on July 9 and July 15, 2009 and concluded that the request was consistent with the requirements of Chapter 13 of the City Lease Policies; and

WHEREAS, Section 13. 2. C of the Lease Policies provide that all subleases must be approved by the City Council after a recommendation is provided by the City Manager and the Lease Committee; and

WHEREAS, The Lease Committee recommends that the Council approve the requested sub-lease and authorize the City Manager to negotiate and execute the necessary lease amendment.

NOW, THEREFORE, BE IT RESOLVED that the Homer City Council hereby approves the request by Homer Enterprises, LLC to sublease an existing building on leased land to Homer Shipping Center and authorizes the City Manager to negotiate and execute the necessary lease amendment.
