RESOLUTION 99-72
A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA REGARDING THE VETERANS MEMORIAL PARK MAINTENANCE
WHEREAS, the City of Homer is the property owner of Lots 39, 40, 41, 42, 43 and 44, W.R. Benson Subdivision; and
WHEREAS, the City of Homer and the American Legion Auxiliary entered into a Memorandum of Understanding (MOU) for the development of this area as the Veterans Memorial Park on March 27, 1991; and
WHEREAS, the City agreed in the above referenced MOU to maintain and operate the Veterans Memorial as a city park; and,
WHEREAS, the American Legion Auxiliary, Unit 16 has applied for funding from the Department of Transportation as a TRAAK project;
WHEREAS, the City agrees to maintain the Veterans Memorial Park, including the City of Homer Time Capsule for a period of fifty (50) years; and,
WHEREAS, the City agrees to leave the Memorial Site and the Time Capsule undisturbed from future development.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Homer, Alaska agrees to the following:
1. The City will maintain and operate the Veterans Memorial as a city park for a period of fifty (50) years; and,
2. The City Manager is authorized to amend the MOU to add the condition that the Memorial Site and the Time Capsule will be undisturbed from future development.
PASSED AND ADOPTED by the Homer City Council this 23rd day of August 1999.

SUBJECT: RESOLUTION 99- REGARDING THE VETERANS MEMORIAL PARK MAINTENANCE
The City of Homer and the American Legion Auxiliary entered into a Memorandum of Agreement on March 27, 1991 for the development of the Veterans Memorial Park. The agreement states, in part, that the City will maintain and operate the Veterans Memorial Park after development of the area by the American Legion.
Currently the American Legion Auxiliary is applying to the Department of Transportation for completion of the park as a TRAAK project. One of the conditions of DOT funding is that maintenance of the facility be assured. The attached memorandum would obligate the City to maintain the park after it is completed, which is already a condition of the MOU.
At the request of the Auxiliary, the resolution would also authorize the City Manager to amend the MOU to add the condition that the Memorial Site and the Time Capsule will be undisturbed by future development
