A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA AUTHORIZING THE SETTLEMENT OF $15,000 FROM ACCOUNT 400.5210.600 TO BE PAID TO TERMINAL OIL SALES, INC. AND AUTHORIZING THE CITY ATTORNEY TO EXECUTE THE APPROPRIATE DOCUMENTS.

WHEREAS, in the matter of TOS, Inc. versus Chevron USA, Inc. and the City of Homer, case number 3HO-99-8 CIV, the City of Homer has been released from all liability by Chevron USA dated August 9, 1999; and

WHEREAS, TOS, Inc. has accepted the City of Homer's offer of judgement in the amount of $15,000 and complete satisfaction of all claims against the City of Homer.

NOW, THEREFORE, BE IT RESOLVED that the City Council of Homer, Alaska hereby authorizes the settlement of $15,000 from account 400.5210.600 to be paid to Terminal Oil Sales, Inc. and authorizes the City Attorney to execute the appropriate documents.

PASSED AND ADOPTED by the City Council of Homer, Alaska this 27th day of September, 1999.
