Ordinance 16-11 Amending HCC Fine Schedule and Use of Load and Launch Ramp

AN ORDINANCE OF THE CITY COUNCIL OF HOMER, ALASKA, AMENDING HOMER CITY CODE 1.16.040, DISPOSITION OF SCHEDULED OFFENSES—FINE SCHEDULE, AND ENACTING Homer City Code 10.04.085 Use of LOAD AND LAUNCH RAMP, TO REGULATE THE USE OF THE load and launch ramp IN THE SMALL BOAT HARBOR.

WHEREAS, The City recently reconstructed and upgraded the load and launch ramp in the Homer Small Boat Harbor; and

WHEREAS, Beginning on April 1 through October 15, individuals using the load and launch ramp in the Homer Small Boat Harbor must pay a daily fee or obtain a seasonal permit in accordance with the fee schedule found in the harbor tariff, which is payable at a booth with an attendant or an unmanned kiosk at the load and launch ramp; and

 WHEREAS, It is in the best interest of the City and Small Boat Harbor users to provide a penalty for failing to pay the fee for the use of the load and launch ramp.

NOW, THEREFORE, THE CITY OF HOMER ORDAINS:

Section 1.  Subsection (c) of Homer City Code 1.16.040, Disposition of scheduled offenses—fine schedule, is amended by adding new lines to read as follows:

Section 2. Homer City Code 10.04.085, Use of Load and Launch Ramp, is enacted to read as follows:

10.04.085 Use of Load and Launch Ramp

Terms and conditions for use of the Small Boat Harbor load and launch ramp are provided in the Homer port and harbor tariff as amended from time to time.
No person who is obligated to pay a fee for using the Small Boat Harbor load and launch ramp may use the Small Boat Harbor load and launch ramp without first paying the fee prescribed for its use.
A person who is obligated to pay a fee for using the Small Boat Harbor load and launch ramp must make the ticket verifying payment available upon request, or display the seasonal permit on the port side of the permit holder’s vessel.  

Section 3.  This ordinance shall take effect upon its adoption by the Homer City Council.
