RESOLUTION 11-013
A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA AUTHORIZING THE CITY MANAGER TO DISPOSE OF A USED AND SURPLUSED 70 FOOT ALUMINUM GANGWAY PURSUANT TO HCC 18.30.010- 020 AND HCC 18.30.040 (b).
WHEREAS, The Port and Harbor Department has in its possession a used 70 foot aluminum gangway which it has determined to be unneeded and surplus pursuant to HCC 18.30.110; and
WHEREAS, It is estimated that the value of the gangway exceeds $5,000 and it is recommended that the minimum bid be established at $15,000; and
WHEREAS, HCC 18.30.020 provides that “ No supplies, materials, equipment or other personal property of a value of more than five thousand dollars may be sold or otherwise disposed of until the City Council has declared, by motion or resolution, such property surplus, obsolete, or unneeded, or that the transaction is otherwise in the best interest of the City.”; and
WHEREAS, The Parks and Recreation Commission, the Friends of Karen Hornaday Park, and local trail advocates have proposed that the gangway be used as a pedestrian bridge over Woodard Creek; a critical piece of a long standing proposal to connect Karen Hornaday Park to the Hospital and the neighborhoods surrounding the proposed connection point at Cityview Avenue; provided that the idea proves to be feasible; and
WHEREAS, HCC 18.40 (b) provides that “the City Manager may sell, lease, donate, exchange or otherwise dispose of personal property, or an interest therein, to or with another municipality, state, or the United States when and under such terms and conditions as the City Council, in its sole judgment, deems advantageous to the City to do so.”; and
WHEREAS, Nothing in City Code prevents such transactions from taking place between departments within the City of Homer; and
WHEREAS, The Port and Harbor Department and the City Administration want to dispose of and surplus the gangway quickly in order to free up storage space but wish to seek prior Council approval to retain the option of either putting it out to bid or making a transaction with the Public Works Department (Parks and Recreation), including possible donation, whichever is deemed to be in the overall best interest of the City.
NOW, THEREFORE, BE IT RESOLVED that the Homer City Council hereby declares the 70 foot aluminum gangway to be unneeded and surplus and authorizes the City Manager to dispose of it pursuant to either HCC 18.30. 010-020 or HCC 18.30.040 (b) in the best interests of the City.
