RESOLUTION 14-077

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, APPROVING  AMENDMENT ONE TO THE COOPERATIVE AGREEMENT BETWEEN THE ALASKA DEPARTMENT OF FISH AND GAME AND THE CITY OF HOMER REGARDING RENOVATION OF THE HOMER HARBOR BOAT LAUNCH FACILITY.

               WHEREAS, On February 13, 2012, the Homer City Council adopted Resolution 12-008 entitled “A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, APPROVING A COOPERATIVE AGREEMENT BETWEEN THE ALASKA DEPARTMENT OF FISH AND GAME (ADF&G), DIVISION OF SPORT FISH, AND THE CITY OF HOMER, REGARDING REPAIR, REPLACEMENT, AND REHABILITATION OF INFRASTRUCTURE AND FACILITIES AT THE HOMER HARBOR LOAD AND LAUNCH RAMP”; and

               WHEREAS, The Cooperative Agreement (COOP 12-085) provided that  ADF&G would take responsibility for Phase I of the project which included preliminary design and permitting activities; and

               WHEREAS, ADF&G has completed Phase I and is now proposing to assume additional pre-construction activities including 95% design, construction bid documents, and the bidding and procurement process; and

               WHEREAS, Under the Cooperative Agreement, the City agrees to take responsibility for Phase II of the project which is now primarily construction and financial management; and

               WHEREAS, It is necessary to amend Cooperative Agreement 12-085 to reflect changed circumstances and to provide additional clarity and specificity to the roles and responsibilities of the parties as we move into the construction phase.

               WHEREAS, Cooperative Agreement 12-085, as amended, takes the place of, and has the effect of a reimbursable grant agreement; and

               WHEREAS, Amendment One to Cooperative Agreement 12-085 was reviewed by the Homer City Council at its meeting on June 23, 2014.

               NOW, THEREFORE, BE IT RESOLVED that the Homer City Council hereby approves Amendment One to Cooperative Agreement 12-085 between the Alaska Department of Fish and Game and the City of Homer regarding renovation of the Homer Harbor Boat Launch Facility.

               PASSED AND ADOPTED by the Homer City Council this 23rd day of June, 2014.
