RESOLUTION 16-005

A RESOLUTION OF THE HOMER CITY COUNCIL EXCLUDING KENAI PENINSULA BOROUGH PARCEL 17708014 OWNED BY COOK INLET REGION, INC. FROM THE HOMER NATURAL GAS SPECIAL ASSESSMENT DISTRICT.

WHEREAS, Cook Inlet Region, Inc. (“CIRI”) owns the parcel described below (“Property”), and has objected to the assessment of the Property for natural gas distribution improvements:

Legal Description: T6S R13W Sec 20 S.M. HM 09300008 Homer FAA Site Subdivision Tract 37A Homer Recording District

WHEREAS, CIRI acquired the Property under the Alaska Native Claims Settlement Act (“ANCSA”), which exempts such property from assessment if it is undeveloped, and the Property is undeveloped; and

WHEREAS, Because the Property is exempt from assessment under ANCSA, it should be excluded from the Homer Natural Gas Distribution Special Assessment District.

NOW, THEREFORE, BE IT RESOLVED that the following property shall be excluded from the Homer Natural Gas Distribution Special Assessment District:

BE IT FURTHER RESOLVED that the City Clerk shall record this resolution in the Homer Recording District.
