RESOLUTION 17-028
A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, GRANTING A LIMITED PRIVATE PEDESTRIAN ACCESS EASEMENT ALONG THE NORTH WALL OF LAND’S END HOTEL AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE APPROPRIATE DOCUMENTS.
WHEREAS, Land’s End Acquisition Corporation is requesting a limited private access easement for the purpose of providing pedestrian emergency egress from the Land’s End Quarter deck on the second floor and the Chart Room on the first floor; and
WHEREAS, Coastal erosion that occurred during the winter of 2017 threatened the emergency egress stairways on the north wall of the Land’s End Hotel. The piling that supports the stairways need to be rebuilt to direct the stairways more inland; and
WHEREAS, The Land’s End Hotel building is 0.1 feet from the north property line which does not leave enough room on private property to direct the stairways inland; and
WHEREAS, City of Homer End of the Road Park and associated tideland abut the Land’s End Hotel building; and
WHEREAS, This easement will provide a 5 foot wide by 35 foot long egress easement to allow for construction of two new stairways; and
WHEREAS, Land’s End Acquisition Corporation has agreed to pay all survey and legal associated fees with such easement; and
WHEREAS, Land’s End Acquisition Corporation will hold the City harmless and will be responsible for the construction and maintenance of the stairways; and
WHEREAS, The City retains the right to terminate the easement with a 90-day notice.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Homer, Alaska grants a limited private pedestrian access easement along the north wall of Land’s End Hotel and authorizes the City Manager to execute the appropriate documents.
