RESOLUTION 18-082

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, AMENDING THE HOMER CITY COUNCIL OPERATING MANUAL TO CLARIFY THE DUTIES AND OBLIGATIONS OF THE MAYOR PRO TEMPORE.           

Whereas, the City Council of Homer, Alaska elects a Mayor Pro Tempore to act as Mayor in the absence of the Mayor; and

Whereas, the City Council Operating Manual and Homer City Code 2.08.080 describes the election and role of the Mayor Pro Tempore; and

Whereas, language in the 2018 City Council Operating Manual is conflicting and vague regarding the election and role of the Mayor Pro Tempore; and

Whereas, it is in the interest of the City of Homer to include clear language regarding the election and role of the Mayor Pro Tempore in the Homer City Council Operating Manual.

NOW, THEREFORE, BE IT RESOLVED that the City Council of Homer, Alaska, amends the Homer City Council Operating Manual on page 4 under Mayor Pro Tem as follows:

Mayor Pro Tem

A Mayor Pro Tem shall be elected by the majority of the Homer City Council. The term of the Mayor Pro Tem shall be until the call for election by the Homer City Council for a New Mayor Pro Tem. The Mayor Pro tem shall, in the absence of the Mayor, act as Mayor of the City of Homer as though they themselves had taken the Oath of Office of Mayor with all duties, responsibilities and power of the Office of the Mayor for the City of Homer.

By tradition the Council has elected a New Mayor Pro Tem at the same annual meeting when newly elected officials are sworn in. The Mayor Pro Tem, when acting in that capacity, does not lose the privilege or duty to vote as Councilmember.

HCC 2.08.080 At the first meeting of the Council following certification of the municipal election each year, there shall be appointed a Mayor Pro Tempore, by majority vote of Council, to act as Mayor during the Mayor’s temporary absence or disability.

The Mayor Pro Tem shall, in the absence of the Mayor, act as Mayor of the City of Homer as though they themselves had taken the Oath of Office of Mayor with all duties, responsibilities and power of the Office of the Mayor for the City of Homer, including agenda deadline and review, appointments to boards and commissions, Mayoral Proclamations and Recognitions, and other duties of the Mayor.

The Mayor Pro Tem, when acting in that capacity, does not lose the privilege or duty to discuss and vote as Councilmember.
