Resolution 19-011, Deleting Language in the City of Homer Fee Schedule Under Camping Fees

RESOLUTION 19-011

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, DELETING LANGUAGE IN THE CITY OF HOMER FEE SCHEDULE UNDER CAMPING FEES.

WHEREAS, Homer City Code 2.32.040 provides authority for the director of each department of the City, subject to the approval of the City Manager and ratification by the City Council, to promulgate and maintain an administrative fee schedule for services provided by that department; and

WHEREAS, The fee schedule contains information relevant to the assessment of fees and is reviewed annually by departments and submitted to City Council for approval; and

WHEREAS, The language in the Port and Harbor section matches that of the Port of Homer Tariff No. 1 and are amended simultaneously; and

WHEREAS, The language in the Water and Sewer sections was reviewed by the Water and Sewer Rate Task Force and is reviewed by Council annually and amended as needed; and

WHEREAS, The remaining sections of the fee schedule contain information identifying what the fee is for, but do not include specific code definitions, with the exception of the camping section; and

WHEREAS, Resolution 05-05 amended the fee schedule to include code language defining camping to differentiate between the fees at Karen Hornaday Park (then Hillside Park) than on the Homer Spit; and

WHEREAS, The fee scheduled has since been amended so that all camping fees are the same for tent camping or for RV camping at City owned camp sites and the language included under camping no longer serves the purpose it did in prior years; and

WHEREAS, Definitions are updated in City Code as needed and having this definition in the fee schedule creates a clerical challenge when updates occur and are not carried over because there is no trigger to do so as with the Port Terminal Tariff or water and sewer rate reviews.  

NOW, THEREFORE, BE IT RESOLVED that the City of Homer Fee Schedule is hereby amended under Camping Fees as follows:

“Camping” means:

1.            The erection of, or occupancy of any tent.

2.            The placing or leaving of any items normally found at a campsite within campsite such as cook stoves, lanterns, sleeping bags or bedding.

3.            Parking of any camper unit in any area owned or controlled by the City that has been designated a camping area by official signs, in excess of twenty-four hours.
