RESOLUTION 16-047
A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, AUTHORIZING THE FORMATION OF THE ERIC LANE LILLIAN WALLI SUBDIVISION ROAD, DRAINAGE AND SEWER SPECIAL ASSESSMENT DISTRICT, AND AUTHORIZING THE CITY MANAGER TO PROCEED WITH THE PREPARATION AND CONSTRUCTION OF THE PROJECT.
WHEREAS, Eric Lane Lillian Walli Subdivision Road, Drainage and Sewer Special Assessment District includes real property fronting Eric Lane located within the Lillian Walli Subdivision within the City of Homer; and
WHEREAS, A petition for water and sewer improvements for property owners within the Eric Lane Lillian Walli Subdivision Road, Drainage and Sewer Special Assessment District was circulated from July 13 to October 28, 2015; and
WHEREAS, Pursuant to HCC 17.04.040(a)(2) the sufficiency of the petition requires signatures of not less than one half in value of the real property in the proposed improvement district; and
WHEREAS, The City Clerk verified sufficient signatures equal to 58% of the value of real property within the district; and
WHEREAS, Pursuant to HCC 17.04.040(b)(1) a neighborhood meeting was scheduled and held on December 3, 2015; and
WHEREAS, An improvement plan was prepared for the district that includes final boundaries, design, project cost estimate, percentage of the improvement cost to be assessed against properties in the district, method for allocating the assessed cost of the improvement among the properties in the district, time period over which assessments will be financed, and a preliminary assessment roll for the district; and
WHEREAS, Property owners were sent the preliminary assessment roll, notice of right to object, and notice of public hearing; and
WHEREAS, Pursuant to HCC 17.04.050(b) if owners of real property that would bear 50 percent or more of the assessed cost of the improvement file timely written objections the Council may not proceed with the improvement; and
WHEREAS, Written objections were received from two property owners, representing three parcels within the district, 14 percent of the assessed cost of the improvement; and
WHEREAS, A public hearing was held on April 25, 2016 and there was no public testimony; and
WHEREAS, The estimated cost of road and drainage improvements is $796,100 with property owners’ estimated total assessment of $530,733; road and drainage improvements within the subdivision are not eligible for HART Program funds, but the City of Homer will pay one third (1/3) the cost of road/drainage improvements $265,367; and
WHEREAS, The estimated cost of sewer improvements is $262,305 with property owners’ estimated total assessment of 262,305; sewer improvements within the subdivision are not eligible for HAWSP Program funds so the property owners will pay 100% of the cost; and
WHEREAS, Council finds that the road, drainage and sewer improvements are necessary and will benefit the properties to be assessed.
NOW, THEREFORE, BE IT RESOLVED that the Homer City Council authorizes the formation of the Eric Lane Lillian Walli Subdivision Road, Drainage and Sewer Special Assessment District, and authorizes the City Manager to proceed with the preparation and construction of the project.

Fiscal Note: Total estimated project road/drainage: $796,100. Estimated property owner share of road/drainage improvements is $530,733 with the City paying one third (1/3) of the cost: $265,367. Total estimated project sewer: $262,305 with estimated property owner share of sewer improvements $262,305 (100%). Road, drainage, and sewer improvements for Eric Lane Lillian Walli Subdivision are not eligible for HART and HAWSP funds.
