RE: Community Recreation Joint Use Agreement

The City assumed ownership of the Community Schools/Recreation Program in 2006. We have an agreement with the Kenai Peninsula School District for use of facilities and equipment. Our current agreement expired June 30, 2010. The District did extend the agreement verbally until Council reviewed. The District expressed concerns about utilities, custodial staff and supply costs. After some difficulty we have finalized a two year agreement that we feel addresses the concerns of the District and the City.
• The City will be limited to use of the High School and Middle School. Any other school use will require the Coordinator to complete a building use application form. The form will be used to review the class being offered so the District can determine if they have the space and if additional fees should be charged.
• All classes scheduled in the pool will require a building use permit. The theatre use will be limited to one event per semester.
• The Coordinator will be responsible for building security in areas where classes are held.
• The program cannot be expanded or new classes offered beyond the scope of the current program without written approval of the District.
• The City will pay the District $6,000 annually to cover the cost of custodial services and supplies. No additional fees will be required for utilities or rent.
• The City is no longer allowed to schedule “non program” related summer field use on District property. (The City at the request of the previous school administration had scheduled field use for the Soccer Association, The Center, Homer Little League, Pop Warner Football and Homer Softball Association). Starting next year the Borough Maintenance department will be responsible for scheduling field use for all activities not related to the program.
During the last legislative session a $30,000 grant was approved to support the Community Schools/Recreation program for FY 2011 and FY2012. The grant will be awarded to the Homer Foundation for the operation and maintenance of the Recreation Program. I have contacted Joy Steward at the Homer Foundation to discuss using the grant to pay the $6,000 agreement fee and salary costs for the program. Joy will be reviewing the grant conditions and will contact the City to determine how to disperse the grant funds.

RECOMMENDATION: Approve the Agreement for Joint Use of Equipment and Facilities and authorize the City Manger to sign.

FISCAL IMPACT: No increase in program costs. We will seek funding for the $6,000 agreement cost through the grant appropriation.
