SUBJECT:           VACATION OF THE NORTH 10 FEET OF THE EXISTING 20-FOOT WIDE EASEMENT ALONG THE SOUTH BOUNDARY OF LOTS 115 AND 116 AS DEDICATED ON BAY VIEW SUBDIVISION, PLAT HM 839;LOCATED WITHIN THE SW1/4 SW1/4 OF SECTION 21, T06S, R13W S.M., ALASKA WITHIN THE KPB; FILE 2017-062V

 

At their June 26, 2017 meeting, the Kenai Peninsula Borough Planning Commission approved to vacate the north 10 feet of the existing 20-foot wide easement along the south boundary of lots 115 and 116 as dedicated on Bay View Subdivision, Plat HM 839; located within the SW1/4 SW1/4 of Section 21, T06S, R13W S.M., Alaska within the KPB; file 2017-062V.

Notice of vacation was received on July 5, 2017. Per AS 29.40.140, no vacation of a City right-of-way and/or easement may be made without the consent of the City Council.

The City Council has thirty days from June 26, 2017 in which to veto the decision of the Kenai Peninsula Borough Planning Commission.

The Homer Advisory Planning Commission has no objection to granting this vacation as reflected in the minutes of June 12, 2017 staff report given by Max Best.     

RECOMMENDATION:

Voice non objection and consent to vacate the north 10 feet of the existing 20-foot wide easement along the south boundary of lots 115 and 116 as dedicated on Bay View Subdivision, Plat HM 839; located within the SW1/4 SW1/4 of Section 21, T06S, R13W S.M., Alaska within the KPB; file 2017-062V.
