SUBJECT: VACATION OF A PORTION OF THE 33-FOOT WIDE SECTION LINE EASEMENT IN HOMER LYING WITHIN LOT 1 DITTON 2014 REPLAT, PLAT HM 2015-23; LOCATED WITHIN THE NE1/4 OF SECTION 24, T6S, R14W, SM, ALASKA WITHIN THE CITY OF HOMER AND KPB; FILE 2017-098V
At their September 25, 2017 meeting, the Kenai Peninsula Borough Planning Commission approved to vacate a portion of the 33-foot wide section line easement in Homer lying within Lot 1 Ditton 2014 Replat, Plat HM 2015-23; Located within the NE1/4 of Section 24, T6S, R14W, S.M., Alaska within the City of Homer and KPB; File 2017-098V
Notice of vacation was received on September 27, 2017. Per AS 29.40.140, no vacation of a City right-of-way and/or easement may be made without the consent of the City Council.
The City Council has thirty days from September 25, 2017 in which to veto the decision of the Kenai Peninsula Borough Planning Commission.
The Homer Advisory Planning Commission has no objection to granting this vacation as reflected in the minutes of August 2, 2017 staff report given by Max Best.
RECOMMENDATION:
Voice non objection and consent to vacate a portion of the 33-foot wide section line easement in Homer lying within Lot 1 Ditton 2014 Replat, Plat HM 2015-23; Located within the NE1/4 of Section 24, T6S, R14W, S.M., Alaska within the City of Homer and KPB; File 2017-098V.
