SUBJECT: VACATE THAT PORTION OF ERIC LANE RIGHT OF WAY WEST OF WEST HILL ROAD AS DEDICATED ON LILLIAN WALLI ESTATE PLAT HM 88-16

At their January 7, 2019 meeting, the Kenai Peninsula Borough Planning Commission approved to vacate a portion of the Eric Lane Right of Way west of the West Hill Road as dedicated on Lillian Walli Estate Plat HM 88-16
The right-of-way being vacated is unconstructed and located within the E1/2 NE1/4 of Section 24, Township 6 South, Range 14 West, Seward Meridian, Alaska, off of West Hill Road, City of Homer and the Kenai Peninsula Borough. KPB File 2018-149V 

Per AS 29.40.140, no vacation of a City right of way and /or easement may be made without the consent of the City Council.

The City Council has thirty days from January 7, 2019 in which to veto the decision of the Kenai Peninsula Borough Planning Commission. 

The Homer Advisory Planning Commission has no objection to granting this vacation as reflected in the minutes of December 5, 2018 meeting included in the staff report provided by Max Best.

Recommendation
Voice non-objection and consent to vacating that portion of the Eric Lane Right of Way west of the West Hill Road as dedicated on Lillian Walli Estate Plat HM 88-16 located within the E1/2 NE1/4 of Section 24, Township 6 South, Range 14 West, Seward Meridian, Alaska, off of West Hill Road, City of Homer and the Kenai Peninsula Borough.
