RESOLUTION 15-054

 

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, AUTHORIZING LEASE NEGOTIATIONS FOR LOT 19 ON THE HOMER SPIT BETWEEN THE CITY AND JOSE RAMOS, DBA HARBOR GRILL, AND FINDING THAT AWARDING A NEW LEASE TO THE CURRENT LESSEE WITHOUT A COMPETITIVE BIDDING PROCESS IS IN THE PUBLIC INTEREST.

 

               WHEREAS, Jose Ramos’ land lease on Lot 19 expires February 1, 2016 including all options; and

 

               WHEREAS, Mr. Ramos has requested a new lease without a competitive bidding process pursuant to the provisions of Chapter 11.2 (F) of the Lease Policies; and

 

               WHEREAS, The Lease Committee met on March 26 and May 28, 2015 to consider Mr. Ramos’ lease proposal; and

 

               WHEREAS, Given the good lease history with Mr. Ramos, his investment in the property, positive financial flow from the business, and employment of people for the business, the Lease Committee recommends a new lease; and

 

WHEREAS, The Lease Committee recommends that Mr. Ramos be given the opportunity to negotiate a new lease on Lot 19 with a term of twenty years with two 5-year options; and

 

               NOW, THEREFORE, BE IT RESOLVED that the Homer City Council hereby authorizes the City Manager to negotiate a new lease on Lot 19 with Jose Ramos, dba Harbor Grill for a term of twenty years with two 5-year options.

 

               BE IT FURTHER RESOLVED that the City Council finds that it is in the public interest to award a new lease to the current lessee without a competitive bidding process as authorized in Chapter 11.2 (F) of the Lease Policy for the reasons stated above by the Lease Committee.

 

                PASSED AND ADOPTED by the City Council of Homer, Alaska, this 29th day of June, 2015.
