RESOLUTION 16-009

 

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, REQUESTING THAT ANY ADDITIONAL TAXES LEVIED AGAINST COMMERCIAL MARIJUANA ACTIVITIES BY THE KENAI PENINSULA BOROUGH, ON BUSINESESS LOCATED WITHIN THE MUNICIPAL BOUNDARIES OF HOMER, ALASKA, IS REMITTED TO THE CITY OF HOMER.

 

               WHEREAS, The State of Alaska is enacting regulations permitting the cultivation, testing, manufacturing, and retail sales of marijuana; and

 

               WHEREAS, The Kenai Peninsula Borough may find it is in the best interest of the Borough to levy additional taxes on commercial marijuana activities; and

 

WHEREAS, The Kenai Peninsula has the systems and regulations in place as a taxing authority; and

 

               WHEREAS, The City of Homer is proposing to allow for operation of the marijuana industry within municipal boundaries; and

 

WHEREAS, The City of Homer does not desire to set up a redundant taxation system; and

 

WHEREAS, The City of Homer would like to receive industry taxes without unnecessarily driving up the prices and encouraging the black market to prevail because of the layering of taxes.

 

               NOW, THEREFORE, BE IT RESOLVED that the Homer City Council hereby expresses its support for the Kenai Peninsula Borough to collect taxes on the marijuana industries and remit those taxes collected within the municipal boundaries of Homer, back to the City of Homer.

 

               PASSED AND ADOPTED by the Homer City Council this 11th day of January, 2016.
